A JOINT RESOLUTION
1-1 proposing a constitutional amendment to abolish the office of
1-2 constable in Howard County.
1-3 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 18, Article V, Texas Constitution, is
1-5 amended by adding Subsection (h) to read as follows:
1-6 (h) The office of Constable in Howard County is abolished.
1-7 The functions of the office are transferred to the County Sheriff.
1-8 However, the office of Constable is abolished under this subsection
1-9 only if, at the statewide election at which the constitutional
1-10 amendment providing for the abolition of the office in Howard
1-11 County is submitted to and approved by the voters, a majority of
1-12 the voters of Howard County voting on the question at that election
1-13 also favor the amendment.
1-14 SECTION 2. The following temporary provision is added to the
1-15 Texas Constitution:
1-16 TEMPORARY PROVISION. The abolition of the office of
1-17 constable in Howard County under the constitutional amendment
1-18 proposed by the 77th Legislature, Regular Session, 2001, providing
1-19 for the abolition of the office in that county takes effect January
1-20 1, 2002, if the conditions of Section 18(h), Article V, as added by
1-21 that constitutional amendment, are met. This provision expires
1-22 January 2, 2002.
1-23 SECTION 3. This proposed constitutional amendment shall be
1-24 submitted to the voters at an election to be held on November 6,
2-1 2001. The ballot shall be printed to permit voting for or against
2-2 the proposition: "The constitutional amendment providing for the
2-3 abolition of the office of constable in Howard County."
