No. 1243 77R17762 KKA-D R E S O L U T I O N 1-1 BE IT RESOLVED by the House of Representatives of the State 1-2 of Texas, 77th Legislature, Regular Session, 2001, That House Rule 1-3 13, Section 9(a), be suspended in part as provided by House Rule 1-4 13, Section 9(f), to enable the conference committee appointed to 1-5 resolve the differences on Senate Bill No. 1432, relating to 1-6 truancy, high school equivalency programs, and the authority of 1-7 justice, municipal, and certain juvenile courts in relation to 1-8 children and providing criminal penalties, to consider and take 1-9 action on the following matter: 1-10 House Rule 13, Section 9(a)(1), is suspended to permit the 1-11 committee to change text that is not in disagreement by 1-12 substituting "article" for "section" so that added Articles 1-13 45.054(c) and (d), Code of Criminal Procedure, read as follows: 1-14 (c) A court having jurisdiction under this article shall 1-15 endorse on the summons issued to the parent of the individual who 1-16 is the subject of the hearing an order directing the parent to 1-17 appear personally at the hearing and directing the person having 1-18 custody of the individual to bring the individual to the hearing. 1-19 (d) An individual commits an offense if the individual is a 1-20 parent who fails to attend a hearing under this article after 1-21 receiving notice under Subsection (c) that the individual's 1-22 attendance is required. An offense under this subsection is a 1-23 Class C misdemeanor. 1-24 Explanation: The changed text is necessary to correct an 2-1 inadvertent drafting error.
