R E S O L U T I O N
 1-1           BE IT RESOLVED by the House of Representatives of the State
 1-2     of Texas, 77th Legislature, Regular Session, 2001, That House Rule
 1-3     13, Section 9(a), be suspended in part as provided by House Rule
 1-4     13, Section 9(f), to enable the conference committee appointed to
 1-5     resolve the differences on House Bill No. 154, relating to the
 1-6     personal needs allowance for certain Medicaid recipients who are
 1-7     residents of long-term care facilities, to consider and take action
 1-8     on the following matter:
 1-9           House Rule 13, Section 9(a)(4), is suspended to permit the
1-10     committee to add a new section to the bill adding Section
1-11     32.028(h),  Human Resources Code, to read as follows:
1-12           SECTION 3.  Section 32.028, Human Resources Code, is amended
1-13     by adding Subsection (h) to read as follows:
1-14           (h)  The Health and Human Services Commission shall ensure
1-15     that the rules governing the determination of rates paid for
1-16     nursing home services provide for the rate component derived from
1-17     reported liaibility insurance costs to be paid only to those homes
1-18     that purchase liability insurance acceptable to the commission.
1-19           Explanation:  This change is needed to clarify the manner in
1-20     which certain costs of nursing homes may be reimbursed under
1-21     Medicaid.
