R E S O L U T I O N
1-1 BE IT RESOLVED by the House of Representatives of the State
1-2 of Texas, 77th Legislature, Regular Session, 2001, That House Rule
1-3 13, Section 9(a), be suspended in part as provided by House Rule
1-4 13, Section 9(f), to enable the conference committee appointed to
1-5 resolve the differences on S.B. No. 510, relating to the
1-6 procurement methods a political subdivision or a related entity may
1-7 use, to consider and take action on the following matter:
1-8 House Rule 13, Section 9(a)(4), is suspended to permit the
1-9 committee to add text on a matter that is not included in either
1-10 the house or senate version of the bill, to read as follows:
1-11 SECTION 13. Subchapter B, Chapter 44, Education Code, is
1-12 amended by adding Section 44.043 to read as follows:
1-13 Sec. 44.043. RIGHT TO WORK. (a) This section applies to a
1-14 school district while the school district is engaged in:
1-15 (1) procuring goods or services;
1-16 (2) awarding a contract; or
1-17 (3) overseeing procurement or construction for a
1-18 public work or public improvement.
1-19 (b) Notwithstanding any other provision of this chapter, a
1-20 school district:
1-21 (1) may not consider whether a vendor is a member of
1-22 or has another relationship with any organization; and
1-23 (2) shall ensure that its bid specifications and any
1-24 subsequent contract or other agreement do not deny or diminish the
2-1 right of a person to work because of the person's membership or
2-2 other relationship status with respect to any organization.
2-3 Explanation: This change is necessary to ensure that a
2-4 school district, in procuring goods or services, awarding a
2-5 contract, or overseeing procurement or construction of public works
2-6 or public improvements, does not consider a vendor's or other
2-7 person's relationship with any organization.
