                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to excepting certain information maintained by family
 1-3     violence shelter centers and sexual assault programs from
 1-4     disclosure under the public information law.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Subchapter C, Chapter 552, Government Code, is
 1-7     amended by adding Section 552.136 to read as follows:
 1-8           Sec. 552.136.  EXCEPTION: FAMILY VIOLENCE SHELTER CENTER AND
 1-9     SEXUAL ASSAULT PROGRAM INFORMATION.  (a)  In this section:
1-10                 (1)  "Family violence shelter center" has the meaning
1-11     assigned by Section 51.002, Human Resources Code.
1-12                 (2)  "Sexual assault program" has the meaning assigned
1-13     by Section 420.003.
1-14           (b)  Information maintained by a family violence shelter
1-15     center or sexual assault program is excepted from the requirements
1-16     of Section 552.021 if it is information that relates to:
1-17                 (1)  the home address, home telephone number, or social
1-18     security number of an employee or a volunteer worker of a family
1-19     violence shelter center or a sexual assault program, regardless of
1-20     whether the employee or worker complies with Section 552.024;
1-21                 (2)  the location or physical layout of a family
1-22     violence shelter center;
1-23                 (3)  the name, home address, home telephone number, or
1-24     numeric identifier of a current or former client of a family
1-25     violence shelter center or sexual assault program;
 2-1                 (4)  the provision of services, including counseling
 2-2     and sheltering, to a current or former client of a family violence
 2-3     shelter center or sexual assault program;
 2-4                 (5)  the name, home address, or home telephone number
 2-5     of a private donor to a family violence shelter center or sexual
 2-6     assault program; or
 2-7                 (6)  the home address or home telephone number of a
 2-8     member of the board of directors or the board of trustees of a
 2-9     family violence shelter center or sexual assault program,
2-10     regardless of whether the board member complies with Section
2-11     552.024.
2-12           SECTION 2.  This Act takes effect immediately if it receives
2-13     a vote of two-thirds of all the members elected to each house, as
2-14     provided by Section 39, Article III, Texas Constitution.  If this
2-15     Act does not receive the vote necessary for immediate effect, this
2-16     Act takes effect September 1, 2001.
