                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to county and public health district fees in certain
 1-2     populous counties.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subsection (a), Section 437.0123, Health and
 1-5     Safety Code, is amended to read as follows:
 1-6           (a)  A county that has a population of at least one [2.8]
 1-7     million or a public health district at least part of which is in a
 1-8     county that has a population of at least 2.8 million may require
 1-9     the payment of a fee for issuing or renewing a permit or for
1-10     performing an inspection to enforce this chapter or a rule adopted
1-11     under this chapter.  A county with a population of at least 2.8
1-12     million may require a trained food manager to be on duty during
1-13     each day of operation of a food service establishment.  The
1-14     training required of food managers can be no more extensive than
1-15     that specified under Subchapter D, Chapter 438.  A food service
1-16     establishment that handles only prepackaged food and does not
1-17     prepare or package food may not be required to have a certified
1-18     food manager under this section.
1-19           SECTION 2.  This Act takes effect September 1, 2001.
