1-1                                   AN ACT
 1-2     relating to the removal of members of the board of regents of
 1-3     Midwestern State University.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 103, Education Code, is amended by adding
 1-6     Section 103.031 to read as follows:
 1-7           Sec. 103.031.  GROUNDS FOR REMOVAL OF BOARD MEMBER.  (a)  It
 1-8     is a ground for removal from the board that a member:
 1-9                 (1)  commits malfeasance of office;
1-10                 (2)  cannot, because of illness or disability,
1-11     discharge the member's duties for a substantial part of the
1-12     member's term; or
1-13                 (3)  is absent from more than half of the regularly
1-14     scheduled board meetings that the member is eligible to attend
1-15     during a calendar year, unless the absence is excused by majority
1-16     vote of the board.
1-17           (b)  The validity of an action of the board is not affected
1-18     by the fact that it was taken when a ground for removal of a board
1-19     member existed.
1-20           SECTION 2.  This Act takes effect immediately.
