A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to local government plans to respond to natural,
1-3 technological, and man-made hazards, including acts of terrorism.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 418.106, Government Code, is amended by
1-6 amending Subsection (b) and adding Subsections (d) and (e) to read
1-7 as follows:
1-8 (b) The plan must [provide for]:
1-9 (1) provide for wage, price, and rent controls and
1-10 other economic stabilization methods in the event of a disaster;
1-11 [and]
1-12 (2) provide for curfews, blockades, and limitations on
1-13 utility use in an area affected by a disaster, rules governing
1-14 entrance to and exit from the affected area, and other security
1-15 measures; and
1-16 (3) address natural, technological, and man-made
1-17 hazards, including acts or threatened acts of terrorism involving
1-18 the use or threatened use of:
1-19 (A) conventional weapons;
1-20 (B) nuclear devices and materials;
1-21 (C) chemical agents; or
1-22 (D) biological agents.
1-23 (d) In developing the plan to address nuclear devices or
1-24 materials and biological agents, the local or interjurisdictional
1-25 agency may consult with the Texas Department of Health.
2-1 (e) The emergency management plans adopted under this
2-2 section must follow the standards and requirements adopted by the
2-3 division under Section 418.043.
2-4 SECTION 2. This Act takes effect immediately if it receives
2-5 a vote of two-thirds of all the members elected to each house, as
2-6 provided by Section 39, Article III, Texas Constitution. If this
2-7 Act does not receive the vote necessary for immediate effect, this
2-8 Act takes effect September 1, 2001.

2-10 Amend C.S.S.B. No. 94 by inserting the following
2-11 appropriately numbered section to read as follows:
2-12 SECTION ____. Amend the Government Code by adding Section
2-13 552.133 to read as follows:
2-14 Sec. 552.133. EXCEPTION: BIOTERRORISM RESPONSE PLANNING
2-15 DOCUMENTS. The plans provided for under Section 418.106, Government
2-16 Code, are excepted from the requirements of Section 552.021.
