 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to local government plans to respond to natural,
1-11     technological, and man-made hazards, including acts of terrorism.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Section 418.106, Government Code, is amended by
1-14     amending Subsection (b) and adding Subsections (d) and (e) to read
1-15     as follows:
1-16           (b)  The plan must [provide for]:
1-17                 (1)  provide for wage, price, and rent controls and
1-18     other economic stabilization methods in the event of a disaster;
1-19     [and]
1-20                 (2)  provide for curfews, blockades, and limitations on
1-21     utility use in an area affected by a disaster, rules governing
1-22     entrance to and exit from the affected area, and other security
1-23     measures; and
1-24                 (3)  address natural, technological, and man-made
1-25     hazards, including acts or threatened acts of terrorism involving
1-26     the use or threatened use of:
1-27                       (A)  conventional weapons;
1-28                       (B)  nuclear devices and materials;
1-29                       (C)  chemical agents; or
1-30                       (D)  biological agents.
1-31           (d)  In developing the plan to address nuclear devices or
1-32     materials and biological agents, the local or interjurisdictional
1-33     agency may consult with the Texas Department of Health.
1-34           (e)  The emergency management plans adopted under this
1-35     section must follow the standards and requirements adopted by the
1-36     division under Section 418.043.
1-37           SECTION 2.  This Act takes effect immediately if it receives
1-38     a vote of two-thirds of all the members elected to each house, as
1-39     provided by Section 39, Article III, Texas Constitution.  If this
1-40     Act does not receive the vote necessary for immediate effect, this
1-41     Act takes effect September 1, 2001.
