                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to an evaluation of required copayments from recipients of
 1-3     medical assistance through managed care.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter B, Chapter 531, Government Code, is
 1-6     amended by adding Section 531.055 to read as follows:
 1-7           Sec. 531.055.  EVALUATION OF COPAYMENT REQUIREMENTS.
 1-8     (a)  The commission shall:
 1-9                 (1)  evaluate the feasibility of requiring Medicaid
1-10     recipients including recipients enrolled in a managed care plan, to
1-11     make nominal copayments at the time that services are received, as
1-12     authorized by federal law; and
1-13                 (2)  make recommendations to the legislature based on
1-14     that evaluation.
1-15           (b)  This section expires September 1, 2003.
1-16           SECTION 2.  The Health and Human Services Commission shall
1-17     submit the recommendations required by Section 531.055, Government
1-18     Code, as added by this Act, not later than November 1, 2002.
1-19           SECTION 3.  This Act takes effect immediately if it receives
1-20     a vote of two-thirds of all the members elected to each house, as
1-21     provided by Section 39, Article III, Texas Constitution.  If this
1-22     Act does not receive the vote necessary for immediate effect, this
1-23     Act takes effect September 1, 2001.
