                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to an evaluation of required copayments from recipients of
 1-3     medical assistance through managed care.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter A, Chapter 533, Government Code, is
 1-6     amended by adding Section 533.016 to read as follows:
 1-7           Sec. 533.016.  EVALUATION OF COPAYMENT REQUIREMENTS. (a)  The
 1-8     commission shall:
 1-9                 (1)  evaluate the feasibility of requiring recipients
1-10     enrolled in a managed care plan to make nominal copayments at the
1-11     time that services are received, as authorized by federal law; and
1-12                 (2)  make recommendations to the legislature based on
1-13     that evaluation.
1-14           (b)  This section expires September 1, 2003.
1-15           SECTION 2. The Health and Human Services Commission shall
1-16     submit the recommendations required by Section 533.016, Government
1-17     Code, as added by this Act, not later than November 1, 2002.
1-18           SECTION 3. This Act takes effect immediately if it receives a
1-19     vote of two-thirds of all the members elected to each house, as
1-20     provided by Section 39, Article III, Texas Constitution.  If this
1-21     Act does not receive the vote necessary for immediate effect, this
1-22     Act takes effect September 1, 2001.
