A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the number of members of a commissioners court
1-3 constituting a quorum.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 81.006, Local Government Code, is amended
1-6 to read as follows:
1-7 Sec. 81.006. QUORUM; VOTE REQUIRED FOR TAX LEVY. (a) A
1-8 majority of the full membership [Three members] of the
1-9 commissioners court is [constitute] a quorum for conducting county
1-10 business except the levying of a county tax.
1-11 (b) A county tax may be levied at any regularly scheduled
1-12 meeting of the court when at least two-thirds of the full
1-13 membership [four members] of the court are present.
1-14 (c) A county may not levy a tax unless a majority of the
1-15 full membership [at least three members] of the court vote in favor
1-16 of the levy.
1-17 SECTION 2. Section 81.005(b), Local Government Code, is
1-18 amended to read as follows:
1-19 (b) The county judge or a number of [three] county
1-20 commissioners constituting a quorum may call a special term of the
1-21 court. A special term may continue until the court's business is
1-22 completed.
1-23 SECTION 3. This Act takes effect on the date on which the
1-24 constitutional amendment proposed by the 77th Legislature, Regular
2-1 Session, 2001, increasing the number of county commissioners in
2-2 Harris County, takes effect. If that amendment is not approved by
2-3 the voters, this Act has no effect.
