 1-1 AN ACT
1-2 relating to the renewal of a license to practice chiropractic.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 201.354, Occupations Code, is amended by
1-5 amending Subsection (e) and adding Subsection (g) to read as
 1-6 follows:
1-7 (e) Except as provided by Subsection (g) and Section
1-8 201.355, a person may not renew a license that has been expired for
1-9 one year or more. The person may obtain a new license by
1-10 submitting to reexamination and complying with the requirements and
1-11 procedures for obtaining an original license.
1-12 (g) A person may renew a license that has been expired for
1-13 one year or more if:
1-14 (1) the board determines according to criteria adopted
1-15 by board rule that the person has shown good cause for the failure
1-16 to renew the license; and
1-17 (2) the person pays to the board the required renewal
1-18 fee for each year in which the license was expired and an
1-19 additional fee in an amount equal to the sum of:
1-20 (A) the examination fee for the license,
1-21 multiplied by the number of years the license was expired, prorated
1-22 for fractional years; and
1-23 (B) two times the examination fee for the
1-24 license.
 2-1 SECTION 2. (a) This Act takes effect September 1, 2001.
2-2 (b) The change in law made by this Act applies only to the
2-3 renewal of a license to practice chiropractic that expires on or
2-4 after the effective date of this Act. The renewal of a license to
2-5 practice chiropractic that expires before the effective date of
2-6 this Act is governed by the law in effect on the date the license
2-7 expires, and that law is continued in effect for that purpose.
2-8 (c) The Texas Board of Chiropractic Examiners shall adopt
2-9 rules under Section 201.354(g), Occupations Code, as added by this
2-10 Act, not later than January 1, 2002.
