 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the renewal of a license to practice chiropractic.
 1-9           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10           SECTION 1.  Section 201.354, Occupations Code, is amended by
1-11     amending Subsection (e) and adding Subsection (g) to read as
1-12     follows:
1-13           (e)  Except as provided by Subsection (g) and Section
1-14     201.355, a person may not renew a license that has been expired for
1-15     one year or more.  The person may obtain a new license by
1-16     submitting to reexamination and complying with the requirements and
1-17     procedures for obtaining an original license.
1-18           (g)  A person may renew a license that has been expired for
1-19     one year or more if:
1-20                 (1)  the board determines according to criteria adopted
1-21     by board rule that the person has shown good cause for the failure
1-22     to renew the license; and
1-23                 (2)  the person pays to the board the required renewal
1-24     fee for each year in which the license was expired and an
1-25     additional fee in an amount equal to the sum of:
1-26                       (A)  the examination fee for the license,
1-27     multiplied by the number of years the license was expired, prorated
1-28     for fractional years; and
1-29                       (B)  two times the examination fee for the
1-30     license.
1-31           SECTION 2.  (a)  This Act takes effect September 1, 2001.
1-32           (b)  The change in law made by this Act applies only to the
1-33     renewal of a license to practice chiropractic that expires on or
1-34     after the effective date of this Act.  The renewal of a license to
1-35     practice chiropractic that expires before the effective date of
1-36     this Act is governed by the law in effect on the date the license
1-37     expires, and that law is continued in effect for that purpose.
1-38           (c)  The Texas Board of Chiropractic Examiners shall adopt
1-39     rules under Subsection (g), Section 201.354, Occupations Code, as
1-40     added by this Act, not later than January 1, 2002.
