1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to exempting members of the armed forces from the Texas
1-11 Academic Skills Program.
1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13 SECTION 1. Subsection (r), Section 51.306, Education Code,
1-14 is amended to read as follows:
1-15 (r) This section does not apply to:
1-16 (1) a student who accumulated three or more
1-17 college-level semester credit hours prior to the 1989 fall
1-18 semester;
1-19 (2) a student located outside this state who enrolls
1-20 in a course offered outside this state by an institution of higher
1-21 education;
1-22 (3) a deaf student;
1-23 (4) a student who has graduated with a baccalaureate
1-24 degree from an institution of higher education, an accredited
1-25 private or independent institution of higher education, or an
1-26 accredited out-of-state institution of higher education;
1-27 (5) a student enrolled in a certificate program at a
1-28 community or technical college of one year or less; [or]
1-29 (6) a student who is a citizen of a country other than
1-30 the United States and is not seeking a degree; or
1-31 (7) a student who is serving on active duty as a
1-32 member of the armed forces of the United States.
1-33 SECTION 2. Subsection (g), Section 51.3061, Education Code,
1-34 is amended to read as follows:
1-35 (g) This section does not apply to a student who is:
1-36 (1) enrolled in a certificate program of one year or
1-37 less; or
1-38 (2) serving on active duty as a member of the armed
1-39 forces of the United States.
1-40 SECTION 3. This Act takes effect immediately if it receives
1-41 a vote of two-thirds of all the members elected to each house, as
1-42 provided by Section 39, Article III, Texas Constitution. If this
1-43 Act does not receive the vote necessary for immediate effect, this
1-44 Act takes effect September 1, 2001.
