                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the authority of a juvenile justice alternative
 1-3     education program to obtain a waiver regarding required days of
 1-4     operation.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Subsection (f), Section 37.011, Education Code,
 1-7     is amended to read as follows:
 1-8           (f)  A juvenile justice alternative education program must
 1-9     operate at least[:]
1-10                 [(1)]  seven hours per day[;] and
1-11                 [(2)]  180 days per year, except that a program may
1-12     apply to the Texas Juvenile Probation Commission for a waiver of
1-13     the 180-day requirement.  The commission may not grant a waiver to
1-14     a program under this subsection for a number of days that exceeds
1-15     the highest number of instructional days waived by the commissioner
1-16     during the same school year for a school district served by the
1-17     program.
1-18           SECTION 2.   This Act applies beginning with the 2001-2002
1-19     school year.
1-20           SECTION 3.   This Act takes effect immediately if it receives
1-21     a vote of two-thirds of all the members elected to each house, as
1-22     provided by Section 39, Article III, Texas Constitution.  If this
1-23     Act does not receive the vote necessary for immediate effect, this
1-24     Act takes effect September 1, 2001.
