 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the authority of a juvenile justice alternative
1-11     education program to obtain a waiver regarding required days of
1-12     operation.
1-13           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14           SECTION 1.  Subsection (f), Section 37.011, Education Code,
1-15     is amended to read as follows:
1-16           (f)  A juvenile justice alternative education program must
1-17     operate at least[:]
1-18                 [(1)]  seven hours per day[;] and
1-19                 [(2)]  180 days per year, except that a program may
1-20     apply to the Texas Juvenile Probation Commission for a waiver of
1-21     the 180-day requirement.  The commission may not grant a waiver to
1-22     a program under this subsection for a number of days that exceeds
1-23     the highest number of instructional days waived by the commissioner
1-24     during the same school year for a school district served by the
1-25     program.
1-26           SECTION 2.   This Act applies beginning with the 2001-2002
1-27     school year.
1-28           SECTION 3.   This Act takes effect immediately if it receives
1-29     a vote of two-thirds of all the members elected to each house, as
1-30     provided by Section 39, Article III, Texas Constitution.  If this
1-31     Act does not receive the vote necessary for immediate effect, this
1-32     Act takes effect September 1, 2001.
