No. 192 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to inclusion of certain ports of entry in state highway 1-3 planning and funding. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter I, Chapter 201, Transportation Code, 1-6 is amended by adding Section 201.710 to read as follows: 1-7 Sec. 201.710. PLANNING AND FUNDING OF PORTS OF ENTRY. (a) 1-8 In this section: 1-9 (1) "Port of entry" means a place designated by 1-10 executive order of the president of the United States, by order of 1-11 the United States secretary of the treasury, or by Act of the 1-12 United States Congress at which a customs officer is authorized to 1-13 accept entries of merchandise to collect duties, and to enforce the 1-14 various provisions of the customs and navigation laws. 1-15 (2) "Project related to a port of entry" means a 1-16 transportation project on the state highway system related to 1-17 access to a port of entry in this state. 1-18 (b) This section applies only to a port of entry on the 1-19 border with the United Mexican States. This section does not apply 1-20 to a port of entry at an airport. 1-21 (c) The department shall include projects related to ports 1-22 of entry in its unified transportation program or any successor to 1-23 that program. 1-24 (d) A metropolitan planning organization that has a port of 2-1 entry within its jurisdiction shall include projects related to 2-2 ports of entry in its transportation improvement plan. 2-3 (e) In allocating money to projects, the department shall 2-4 fund projects related to ports of entry from money other than North 2-5 American Free Trade Agreement discretionary funds. 2-6 SECTION 2. This Act takes effect September 1, 2001.
