 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to inclusion of certain ports of entry in state highway
1-11     planning and funding.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Subchapter I, Chapter 201, Transportation Code,
1-14     is amended by adding Section 201.710 to read as follows:
1-15           Sec. 201.710.  PLANNING AND FUNDING OF PORTS OF ENTRY.
1-16     (a)  In this section:
1-17                 (1)  "Port of entry" means a place designated by
1-18     executive order of the president of the United States, by order of
1-19     the United States secretary of the treasury, or by Act of the
1-20     United States Congress at which a customs officer is authorized to
1-21     accept entries of merchandise, to collect duties, and to enforce
1-22     the various provisions of the customs and navigation laws.
1-23                 (2)  "Project related to a port of entry" means a
1-24     transportation project on the state highway system related to
1-25     access to a port of entry in this state.
1-26           (b)  This section applies only to a port of entry on the
1-27     border with the United Mexican States.  This section does not apply
1-28     to a port of entry at an airport.
1-29           (c)  The department shall include projects related to ports
1-30     of entry in its unified transportation program or any successor to
1-31     that program.
1-32           (d)  A metropolitan planning organization that has a port of
1-33     entry within its jurisdiction shall include projects related to
1-34     ports of entry in its transportation improvement plan.
1-35           (e)  In allocating money to projects, the department shall
1-36     fund projects related to ports of entry from money other than North
1-37     American Free Trade Agreement discretionary funds.
1-38           SECTION 2.  This Act takes effect September 1, 2001.
