By Harris S.B. No. 231 77R1484 AJA-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the liability of a governmental unit for an act or 1-3 omission of an off-duty law enforcement officer. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 101.065, Civil Practice and Remedies 1-6 Code, is amended to read as follows: 1-7 Sec. 101.065. NEGLIGENCE OF OFF-DUTY LAW ENFORCEMENT 1-8 OFFICERS. This chapter does not apply to the wrongful act or 1-9 omission or the negligence of an officer commissioned by the 1-10 Department of Public Safety or a law enforcement officer employed 1-11 by a county or municipality if the officer was not on active duty 1-12 at the time the act, omission, or negligence occurred. This 1-13 section applies without regard to whether the officer was wearing a 1-14 uniform purchased under Section 411.0078, Government Code, at the 1-15 time the act, omission, or negligence occurred. 1-16 SECTION 2. (a) This Act takes effect September 1, 2001. 1-17 (b) The change in law made by this Act applies only to a 1-18 cause of action that accrues on or after the effective date of this 1-19 Act. A cause of action that accrues before the effective date of 1-20 this Act is governed by the law in effect immediately before that 1-21 date, and that law is continued in effect for that purpose.
