                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the penalty for certain speeding offenses.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. Subchapter H, Chapter 545, Transportation Code, is
 1-5     amended by adding Section 545.366 to read as follows:
 1-6           Sec. 545.366.  PENALTY: EXCEEDING SPEED LIMIT BY 25 MILES PER
 1-7     HOUR OR MORE.  A person who commits an offense under this subtitle
 1-8     by exceeding an applicable maximum speed limit by 25 miles per hour
 1-9     or more shall be punished by a fine of not less than $200 or more
1-10     than $500.
1-11           SECTION 2.  (a)  The change in law made by this Act applies
1-12     only to an offense committed on or after the effective date of this
1-13     Act.  For the purposes of this section, an offense is committed
1-14     before the effective date of this Act if any element of the offense
1-15     occurs before that date.
1-16           (b)  An offense committed before the effective date of this
1-17     Act is governed by the law in effect when the offense was
1-18     committed, and the former law is continued in effect for that
1-19     purpose.
1-20           SECTION 3. This Act takes effect September 1, 2001.
