No. 268 1-2 (In the Senate - Filed January 17, 2001; January 22, 2001, 1-3 read first time and referred to Committee on Criminal Justice; 1-4 March 12, 2001, reported favorably by the following vote: Yeas 4, 1-5 Nays 2; March 12, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the penalty for certain speeding offenses. 1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-10 SECTION 1. Subchapter H, Chapter 545, Transportation Code, 1-11 is amended by adding Section 545.366 to read as follows: 1-12 Sec. 545.366. PENALTY: EXCEEDING SPEED LIMIT BY 25 MILES 1-13 PER HOUR OR MORE. A person who commits an offense under this 1-14 subtitle by exceeding an applicable maximum speed limit by 25 miles 1-15 per hour or more shall be punished by a fine of not less than $200 1-16 or more than $500. 1-17 SECTION 2. (a) The change in law made by this Act applies 1-18 only to an offense committed on or after the effective date of this 1-19 Act. For the purposes of this section, an offense is committed 1-20 before the effective date of this Act if any element of the offense 1-21 occurs before that date. 1-22 (b) An offense committed before the effective date of this 1-23 Act is governed by the law in effect when the offense was 1-24 committed, and the former law is continued in effect for that 1-25 purpose. 1-26 SECTION 3.
