                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the meaning of "agricultural crop" for purposes of the
 1-3     exemption of certain wells from fees charged by the North Harris
 1-4     County Regional Water Authority.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 1.02, Chapter 1029, Acts of the 76th
 1-7     Legislature, Regular Session, 1999, is amended by amending
 1-8     Subdivision (11) and adding Subdivisions (12), (13), and (14) to
 1-9     read as follows:
1-10                 (11)  "Agricultural crop" means:
1-11                       (A)  a food or fiber commodity [commodities]
1-12     grown for resale or commercial purposes that provides [provide]
1-13     food, clothing, or animal feed; or
1-14                       (B)  a nursery product or florist item while in
1-15     the hands of a nursery grower.
1-16                 (12)  "Florist item" means a cut flower, potted plant,
1-17     blooming plant, inside foliage plant, bedding plant, corsage
1-18     flower, cut foliage, floral decoration, or live decorative
1-19     material.
1-20                 (13)  "Nursery grower" means a person who grows, in any
1-21     medium, more than 50 percent of the nursery products or florist
1-22     items that the person either sells or leases, regardless of the
1-23     variety sold, leased, or grown.  For the purposes of this
1-24     definition, "grow" means the actual cultivation or propagation of
1-25     the nursery product or florist item beyond the mere holding or
 2-1     maintaining of the item prior to sale or lease and typically
 2-2     includes activities associated with the production or multiplying
 2-3     of stock such as the development of new plants from cuttings,
 2-4     grafts, plugs, or seedlings.
 2-5                 (14)  "Nursery product" includes a tree, shrub, vine,
 2-6     cutting, graft, scion, grass, bulb, or bud that is grown for, kept
 2-7     for, or is capable of propagation and distribution for sale or
 2-8     lease.
 2-9           SECTION 2.  This Act takes effect September 1, 2001.
