No. 276 1-2 (In the Senate - Filed January 18, 2001; January 22, 2001, 1-3 read first time and referred to Committee on Jurisprudence; 1-4 February 27, 2001, reported favorably by the following vote: Yeas 1-5 6, Nays 0; February 27, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the application of a seal to an electronic document. 1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-10 SECTION 1. Section 121.004, Civil Practice and Remedies 1-11 Code, is amended by adding Subsection (d) to read as follows: 1-12 (d) The application of an embossed seal is not required on 1-13 an electronically transmitted certificate of an acknowledgement. 1-14 SECTION 2. Section 406.013, Government Code, is amended by 1-15 adding Subsection (d) to read as follows: 1-16 (d) Subsection (c) does not apply to an electronically 1-17 transmitted authenticated document, except that an electronically 1-18 transmitted authenticated document must legibly reproduce the 1-19 required elements of the seal. 1-20 SECTION 3. This Act takes effect immediately if it receives 1-21 a vote of two-thirds of all the members elected to each house, as 1-22 provided by Section 39, Article III, Texas Constitution. If this 1-23 Act does not receive the vote necessary for immediate effect, this 1-24 Act takes effect September 1, 2001. 1-25 * * * * *
