                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the financial transactions of a community supervision
 1-3     and corrections department.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 76.004, Government Code, is amended to
 1-6     read as follows:
 1-7           Sec. 76.004.  DEPARTMENT DIRECTOR; FISCAL OFFICER.  (a)  The
 1-8     district judge or judges shall appoint a department director who
 1-9     must meet, at a minimum, the eligibility requirements for officers
1-10     established under Section 76.005.
1-11           (b)  The department director shall employ a sufficient number
1-12     of officers and other employees to perform the professional and
1-13     clerical work of the department.
1-14           (c)  The district judge or judges may appoint for the
1-15     department a fiscal officer, other than the county auditor, who is
1-16     responsible for the financial transactions of the department.
1-17           (d)  If the district judge or judges appoint a fiscal officer
1-18     under Subsection (c), the department shall pay from the
1-19     department's funds all costs associated with employing the officer
1-20     and ensuring that all financial transactions of the department are
1-21     lawful.
1-22           SECTION 2.  This Act takes effect September 1, 2001.
