                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to posting notice about a violation of certain municipal
 1-3     ordinances or requirements.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 342.006(b), Health and Safety Code, is
 1-6     amended to read as follows:
 1-7           (b)  The notice must be given:
 1-8                 (1)  personally to the owner in writing;
 1-9                 (2)  by letter addressed to the owner at the owner's
1-10     address as recorded in the appraisal district records of the
1-11     appraisal district in which the property is located; or
1-12                 (3)  if personal service cannot be obtained:
1-13                       (A)  by publication at least once; or
1-14                       (B)  by posting the notice in a conspicuous place
1-15     [on or near the front door of each building] on the property to
1-16     which the violation relates[; or]
1-17                       [(C)  by posting the notice on a placard attached
1-18     to a stake driven into the ground on the property to which the
1-19     violation relates, if the property contains no buildings].
1-20           SECTION 2.  This Act takes effect immediately if it receives
1-21     a vote of two-thirds of all the members elected to each house, as
1-22     provided by Section 39, Article III, Texas Constitution.  If this
1-23     Act does not receive the vote necessary for immediate effect, this
1-24     Act takes effect September 1, 2001.
