                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the continuation and functions of the State Aircraft
 1-3     Pooling Board.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter A, Chapter 2205, Government Code, is
 1-6     amended by adding new Sections 2205.017 and 2205.018 and by
 1-7     redesignating existing Section 2205.017 as Section 2205.019 and
 1-8     amending the redesignated section to read as follows:
 1-9           Sec. 2205.017.  INFORMATION ON COMPLAINTS.  (a)  The board
1-10     shall maintain a file on each written complaint filed with the
1-11     board.  The file must include:
1-12                 (1)  the name of the person who filed the complaint;
1-13                 (2)  the date the complaint is received by the board;
1-14                 (3)  the subject matter of the complaint;
1-15                 (4)  the name of each person contacted in relation to
1-16     the complaint;
1-17                 (5)  a summary of the results of the review or
1-18     investigation of the complaint; and
1-19                 (6)  an explanation of the reason the file was closed,
1-20     if the board closed the file without taking action other than to
1-21     investigate the complaint.
1-22           (b)  The board shall provide to the person filing the
1-23     complaint and to each person who is a subject of the complaint a
1-24     copy of the board's policies and procedures relating to complaint
1-25     investigation and resolution.
 2-1           (c)  The board, at least quarterly until final disposition of
 2-2     the complaint, shall notify the person filing the complaint and
 2-3     each person who is a subject of the complaint of the status of the
 2-4     investigation unless the notice would jeopardize an undercover
 2-5     investigation.
 2-6           Sec. 2205.018.  STATE EMPLOYEE INCENTIVE PROGRAM.  The
 2-7     executive director or the executive director's designee shall
 2-8     provide to employees of the board information and training on the
 2-9     benefits and methods of participation in the State Employee
2-10     Incentive Program.
2-11           Sec. 2205.019.  SUNSET PROVISION.  The State Aircraft Pooling
2-12     Board is subject to Chapter 325 (Texas Sunset Act).  Unless
2-13     continued in existence as provided by that chapter, the board is
2-14     abolished and this chapter expires September 1, 2013 [2001].
2-15           SECTION 2.  Section 2205.032, Government Code, is amended by
2-16     adding Subsection (c) to read as follows:
2-17           (c)  As part of the strategic plan that the board develops
2-18     and submits under Chapter 2056, the board shall develop a
2-19     long-range plan for its pool of aircraft.  The board shall include
2-20     appropriate portions of the long-range plan in its legislative
2-21     appropriations request.  The long-range plan must include estimates
2-22     of future aircraft replacement needs and other fleet management
2-23     needs, including any projected need to increase or decrease the
2-24     number of aircraft in the pool.  In developing the long-range plan,
2-25     the board shall consider at a minimum for each aircraft in the
2-26     pool:
 3-1                 (1)  how much the aircraft is used and the purposes for
 3-2     which it is used;
 3-3                 (2)  the cost of operating the aircraft and the revenue
 3-4     generated by the aircraft; and
 3-5                 (3)  the demand for the aircraft or for that type of
 3-6     aircraft.
 3-7           SECTION 3.  Subchapter B, Chapter 2205, Government Code, is
 3-8     amended by adding Section 2205.047 to read as follows:
 3-9           Sec. 2205.047.  INFORMATION POSTED ON THE INTERNET.  The
3-10     board shall post information related to travel and other services
3-11     provided by the board on an Internet site maintained by or for the
3-12     board.  The site must be generally accessible to state agencies,
3-13     persons who use the board's services, and, to the extent
3-14     appropriate, the general public.
3-15           SECTION 4.  This Act takes effect September 1, 2001.
