 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the continuation and functions of the State Aircraft
 1-9     Pooling Board.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Subchapter A, Chapter 2205, Government Code, is
1-12     amended by adding new Sections 2205.017 and 2205.018 and by
1-13     redesignating existing Section 2205.017 as Section 2205.019 and
1-14     amending the redesignated section to read as follows:
1-15           Sec. 2205.017.  INFORMATION ON COMPLAINTS.  (a)  The board
1-16     shall maintain a file on each written complaint filed with the
1-17     board.  The file must include:
1-18                 (1)  the name of the person who filed the complaint;
1-19                 (2)  the date the complaint is received by the board;
1-20                 (3)  the subject matter of the complaint;
1-21                 (4)  the name of each person contacted in relation to
1-22     the complaint;
1-23                 (5)  a summary of the results of the review or
1-24     investigation of the complaint; and
1-25                 (6)  an explanation of the reason the file was closed,
1-26     if the board closed the file without taking action other than to
1-27     investigate the complaint.
1-28           (b)  The board shall provide to the person filing the
1-29     complaint and to each person who is a subject of the complaint a
1-30     copy of the board's policies and procedures relating to complaint
1-31     investigation and resolution.
1-32           (c)  The board, at least quarterly until final disposition of
1-33     the complaint, shall notify the person filing the complaint and
1-34     each person who is a subject of the complaint of the status of the
1-35     investigation unless the notice would jeopardize an undercover
1-36     investigation.
1-37           Sec. 2205.018.  STATE EMPLOYEE INCENTIVE PROGRAM.  The
1-38     executive director or the executive director's designee shall
1-39     provide to employees of the board information and training on the
1-40     benefits and methods of participation in the State Employee
1-41     Incentive Program.
1-42           Sec. 2205.019.  SUNSET PROVISION.  The State Aircraft Pooling
1-43     Board is subject to Chapter 325 (Texas Sunset Act).  Unless
1-44     continued in existence as provided by that chapter, the board is
1-45     abolished and this chapter expires September 1, 2013 [2001].
1-46           SECTION 2.  Section 2205.032, Government Code, is amended by
1-47     adding Subsection (c) to read as follows:
1-48           (c)  As part of the strategic plan that the board develops
1-49     and submits under Chapter 2056, the board shall develop a
1-50     long-range plan for its pool of aircraft.  The board shall include
1-51     appropriate portions of the long-range plan in its legislative
1-52     appropriations request.  The long-range plan must include estimates
1-53     of future aircraft replacement needs and other fleet management
1-54     needs, including any projected need to increase or decrease the
1-55     number of aircraft in the pool.  In developing the long-range plan,
1-56     the board shall consider at a minimum for each aircraft in the
1-57     pool:
1-58                 (1)  how much the aircraft is used and the purposes for
1-59     which it is used;
1-60                 (2)  the cost of operating the aircraft and the revenue
1-61     generated by the aircraft; and
1-62                 (3)  the demand for the aircraft or for that type of
1-63     aircraft.
1-64           SECTION 3.  Subchapter B, Chapter 2205, Government Code, is
 2-1     amended by adding Section 2205.047 to read as follows:
 2-2           Sec. 2205.047.  INFORMATION POSTED ON THE INTERNET.  The
 2-3     board shall post information related to travel and other services
 2-4     provided by the board on an Internet site maintained by or for the
 2-5     board.  The site must be generally accessible to state agencies,
 2-6     persons who use the board's services, and, to the extent
 2-7     appropriate, the general public.
 2-8           SECTION 4.  This Act takes effect September 1, 2001.
