1-2 relating to the application of the sunset review process to certain
1-3 governmental entities.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 ARTICLE 1. ENTITIES GIVEN 2005 SUNSET DATE
1-6 SECTION 1.01. STATE BOARD OF BARBER EXAMINERS. Section
1-7 1601.004, Occupations Code, is amended to read as follows:
1-8 Sec. 1601.004. APPLICATION OF SUNSET ACT. The State Board of
1-9 Barber Examiners is subject to Chapter 325, Government Code (Texas
1-10 Sunset Act). Unless continued in existence as provided by that
1-11 chapter, the board is abolished and this chapter expires September
1-12 1, 2005 [2003].
1-13 SECTION 1.02. TEXAS COSMETOLOGY COMMISSION. Section
1-14 1602.004, Occupations Code, is amended to read as follows:
1-15 Sec. 1602.004. APPLICATION OF SUNSET ACT. The Texas
1-16 Cosmetology Commission is subject to Chapter 325, Government Code
1-17 (Texas Sunset Act). Unless continued in existence as provided by
1-18 that chapter, the commission is abolished and this chapter expires
1-19 September 1, 2005 [2003].
1-20 SECTION 1.03. TEXAS VETERANS COMMISSION. Subsection (a),
1-21 Section 434.002, Government Code, is amended to read as follows:
1-22 (a) The Texas Veterans Commission is subject to Chapter 325
1-23 (Texas Sunset Act). Unless continued in existence as provided by
1-24 that chapter, the commission is abolished September 1, 2005 [2003].
2-1 SECTION 1.04. VETERANS' LAND BOARD. Section 161.0111,
2-2 Natural Resources Code, is amended to read as follows:
2-3 Sec. 161.0111. SUNSET PROVISION. The Veterans' Land Board is
2-4 subject to review under Chapter 325, Government Code (Texas Sunset
2-5 Act), but is not abolished under that chapter. The board shall be
2-6 reviewed during the period in which state agencies abolished in
2-7 2005 [2003] and every 12th year after 2005 [2003] are reviewed.
2-8 ARTICLE 2. ENTITIES GIVEN 2007 SUNSET DATE
2-9 SECTION 2.01. TEXAS INCENTIVE AND PRODUCTIVITY COMMISSION.
2-10 Section 2108.007, Government Code, is amended to read as follows:
2-11 Sec. 2108.007. APPLICATION OF SUNSET ACT. The Texas
2-12 Incentive and Productivity Commission is subject to Chapter 325
2-13 (Texas Sunset Act). Unless continued in existence as provided by
2-14 that chapter, the commission is abolished and this chapter expires
2-15 September 1, 2007 [2003].
2-16 SECTION 2.02. RISK MANAGEMENT BOARD. Subsection (f), Section
2-17 412.021, Labor Code, is amended to read as follows:
2-18 (f) The risk management board is subject to Chapter 325,
2-19 Government Code (Texas Sunset Act). Unless continued in existence
2-20 as provided by that chapter, the board is abolished and this
2-21 section expires September 1, 2007 [2009].
2-22 SECTION 2.03. TEXAS REAL ESTATE COMMISSION. Subsection (n),
2-23 Section 5, The Real Estate License Act (Article 6573a, Vernon's
2-24 Texas Civil Statutes), is amended to read as follows:
2-25 (n) The Texas Real Estate Commission is subject to Chapter
2-26 325, Government Code (Texas Sunset Act). Unless continued in
2-27 existence as provided by that chapter, the commission is abolished
3-1 and this Act expires September 1, 2007 [2003].
3-2 SECTION 2.04. TEXAS STRUCTURAL PEST CONTROL BOARD.
3-3 Subsection (e), Section 3, Texas Structural Pest Control Act
3-4 (Article 135b-6, Vernon's Texas Civil Statutes), is amended to read
3-5 as follows:
3-6 (e) The Texas Structural Pest Control Board is subject to
3-7 Chapter 325, Government Code (Texas Sunset Act). Unless continued
3-8 in existence as provided by that chapter, the board is abolished
3-9 and this Act expires September 1, 2007 [2003].
3-10 ARTICLE 3. ENTITIES GIVEN 2009 SUNSET DATE
3-11 SECTION 3.01. POLYGRAPH EXAMINERS BOARD. Section 1703.005,
3-12 Occupations Code, is amended to read as follows:
3-13 Sec. 1703.005. APPLICATION OF SUNSET ACT. The Polygraph
3-14 Examiners Board is subject to Chapter 325, Government Code (Texas
3-15 Sunset Act). Unless continued in existence as provided by that
3-16 chapter, the board is abolished and this chapter expires September
3-17 1, 2009 [2003].
3-18 ARTICLE 4. ENTITIES GIVEN 2011 SUNSET DATE
3-19 SECTION 4.01. TEXAS DEPARTMENT OF HUMAN SERVICES. Section
3-20 21.002, Human Resources Code, is amended to read as follows:
3-21 Sec. 21.002. SUNSET PROVISION. The Texas Department of Human
3-22 Services is subject to Chapter 325, Government Code (Texas Sunset
3-23 Act). Unless continued in existence as provided by that chapter,
3-24 the department is abolished and this title expires September 1,
3-25 2011 [2003], except that Chapter 40 expires as provided by Section
3-26 40.003.
3-27 ARTICLE 5. SPECIAL PURPOSE REVIEW
4-1 SECTION 5.01. TEXAS DEPARTMENT OF HUMAN SERVICES. Chapter
4-2 21, Human Resources Code, is amended by adding Section 21.0021 to
4-3 read as follows:
4-4 Sec. 21.0021. SPECIAL PURPOSE SUNSET REVIEW. (a) During the
4-5 period in which the Sunset Advisory Commission performs its duties
4-6 under Chapter 325, Government Code, in preparing for a report to
4-7 the 78th Legislature, the commission shall perform a special
4-8 purpose review of the department. In the review, the commission is
4-9 limited to reviewing the appropriateness of the recommendations
4-10 made by the commission to the 76th Legislature regarding the
4-11 department. In the commission's report to the 78th Legislature,
4-12 the commission may include any of those prior recommendations the
4-13 commission considers appropriate.
4-14 (b) The department shall cooperate with the commission in
4-15 the review and shall provide to the commission any information the
4-16 commission considers necessary for the review.
4-17 (c) This section expires September 1, 2003.
4-18 ARTICLE 6. ENTITIES REMOVED FROM SUNSET REVIEW
4-19 SECTION 6.01. The following laws are repealed:
4-20 (1) Section 30.026, Education Code (governing board of
4-21 the Texas School for the Blind and Visually Impaired);
4-22 (2) Section 30.058, Education Code (governing board of
4-23 the Texas School for the Deaf);
4-24 (3) Section 86.511, Education Code (Real Estate
4-25 Research Center);
4-26 (4) Section 465.002, Government Code (Texas National
4-27 Research Laboratory Commission);
5-1 (5) Section 752.025, Government Code (Governor's
5-2 Advisory Committee on Immigration and Refugees);
5-3 (6) Section 451.453, Transportation Code (Capital
5-4 Metropolitan Transportation Authority, Corpus Christi Regional
5-5 Transit Authority, and Harris County Metropolitan Rapid Transit
5-6 Authority); and
5-7 (7) Section 452.453, Transportation Code (Dallas Area
5-8 Rapid Transit Authority).
5-9 ARTICLE 7. EFFECTIVE DATE
5-10 SECTION 7.01. This Act takes effect September 1, 2001.
