1-1 AN ACT
1-2 relating to the state child health plan for certain low-income
1-3 children.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 6, Chapter 235, Acts of the 76th
1-6 Legislature, Regular Session, 1999, is amended to read as follows:
1-7 Sec. 6. If, before implementing any provision of Chapter 62,
1-8 Health and Safety Code, as added by this Act, or expanding coverage
1-9 under the state child health plan to include adult family members
1-10 consistent with federal waiver authority, the Health and Human
1-11 Services Commission determines that a waiver or authorization from
1-12 a federal agency is necessary for implementation of that provision
1-13 or coverage expansion, the commission shall request the waiver or
1-14 authorization and may delay implementing that provision until the
1-15 waiver or authorization is granted. The state child health plan or
1-16 a health benefit plan provider that provides health benefits
1-17 coverage to a child enrolled in the state child health plan shall
1-18 be the secondary plan when coordinating benefits with any form of
1-19 group or individual private health benefits coverage or private
1-20 insurance covering the child. Accordingly, any benefits paid for
1-21 the child under the state child health plan shall pay benefits only
1-22 after private coverage benefits have been exhausted.
1-23 SECTION 2. This Act takes effect September 1, 2001.
