A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the state child health plan for certain low-income
1-3 children.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 6, Chapter 235, Acts of the 76th
1-6 Legislature, Regular Session, 1999, is amended to read as follows:
1-7 Sec. 6. If, before implementing any provision of Chapter 62,
1-8 Health and Safety Code, as added by this Act, or expanding coverage
1-9 under the state child health plan to include adult family members
1-10 consistent with federal waiver authority, the Health and Human
1-11 Services Commission determines that a waiver or authorization from
1-12 a federal agency is necessary for implementation of that provision
1-13 or coverage expansion, the commission shall request the waiver or
1-14 authorization and may delay implementing that provision until the
1-15 waiver or authorization is granted. In the event of lapse in
1-16 coverage, the state child health plan or a health benefit plan
1-17 provider that provides health benefits coverage to a child enrolled
1-18 in the state child health plan shall be the secondary plan when
1-19 coordinating benefits with any form of group or individual private
1-20 health benefits coverage or private insurance covering the child.
1-21 Accordingly, any benefits paid for the child under the state child
1-22 health plan shall pay benefits only after private coverage benefits
1-23 have been exhausted.
1-24 SECTION 2. This Act takes effect September 1, 2001.

2-1 Amend S.B. No. 333 (Senate Engrossment), in SECTION 1 of the
2-2 bill, in amended Section 6, Chapter 235, Acts of the 76th
2-3 Legislature, Regular Session, 1999 (page 1, lines 15-16), by
2-4 striking "In the event of lapse in coverage, the" and substituting
2-5 "The".
