 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the state child health plan for certain low-income
1-11     children.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Section 6, Chapter 235, Acts of the 76th
1-14     Legislature, Regular Session, 1999, is amended to read as follows:
1-15           Sec. 6.  If, before implementing any provision of Chapter 62,
1-16     Health and Safety Code, as added by this Act, or expanding coverage
1-17     under the state child health plan to include adult family members
1-18     consistent with federal waiver authority, the Health and Human
1-19     Services Commission determines that a waiver or authorization from
1-20     a federal agency is necessary for implementation of that provision
1-21     or coverage expansion, the commission shall request the waiver or
1-22     authorization and may delay implementing that provision until the
1-23     waiver or authorization is granted.  In the event of lapse in
1-24     coverage, the state child health plan or a health benefit plan
1-25     provider that provides health benefits coverage to a child enrolled
1-26     in the state child health plan shall be the secondary plan when
1-27     coordinating benefits with any form of group or individual private
1-28     health benefits coverage or private insurance covering the child.
1-29     Accordingly, any benefits paid for the child under the state child
1-30     health plan shall pay benefits only after private coverage benefits
1-31     have been exhausted.
1-32           SECTION 2.  This Act takes effect September 1, 2001.
