1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the penalty for threats of violence against certain
1-9 persons.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 22.07, Penal Code, is amended by amending
1-12 Subsection (b) and adding Subsections (c), (d), (e), and (f) to
1-13 read as follows:
1-14 (b) Except as provided by Subsection (c), an [An] offense
1-15 under Subdivision (1) or (2) of Subsection (a) is a Class B
1-16 misdemeanor.
1-17 (c) An offense under Subdivision (2) of Subsection (a) is a
1-18 Class A misdemeanor if it is committed against a member of the
1-19 person's family or household or against a public servant.
1-20 (d) An offense under Subdivision (3) of Subsection (a) is a
1-21 Class A misdemeanor.
1-22 (e) An offense under Subdivision (4) of Subsection (a) is a
1-23 felony of the third degree.
1-24 (f) In this section:
1-25 (1) "Family" has the meaning assigned by Section
1-26 71.003, Family Code.
1-27 (2) "Household" has the meaning assigned by Section
1-28 71.005, Family Code.
1-29 (3) "Public servant" has the meaning assigned by
1-30 Section 1.07.
1-31 SECTION 2. (a) The change in law made by this Act applies
1-32 only to an offense committed on or after the effective date of this
1-33 Act. For purposes of this section, an offense is committed before
1-34 the effective date of this Act if any element of the offense occurs
1-35 before that date.
1-36 (b) An offense committed before the effective date of this
1-37 Act is covered by the law in effect when the offense was committed,
1-38 and the former law is continued in effect for that purpose.
1-39 SECTION 3. This Act takes effect September 1, 2001.
