1-1 AN ACT
1-2 relating to the performance of an autopsy on an individual injured
1-3 in one county and dying in another county.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Article 49.10, Code of Criminal Procedure, is
1-6 amended by adding Subsection (o) to read as follows:
1-7 (o) If a person is injured in one county and dies as a
1-8 result of those injuries, with the death occurring in another
1-9 county, the attorney representing the state in the prosecution of
1-10 felonies in the county in which the injury occurred may request a
1-11 justice of the peace in the county in which the death occurred to
1-12 order an autopsy be performed on the body of the deceased person.
1-13 If the justice of the peace orders that the autopsy be performed,
1-14 the county in which the injury occurred shall reimburse the county
1-15 in which the death occurred.
1-16 SECTION 2. This Act takes effect immediately if it receives
1-17 a vote of two-thirds of all the members elected to each house, as
1-18 provided by Section 39, Article III, Texas Constitution. If this
1-19 Act does not receive the vote necessary for immediate effect, this
1-20 Act takes effect September 1, 2001.
