No. 370 1-2 (In the Senate - Filed January 24, 2001; January 25, 2001, 1-3 read first time and referred to Committee on Jurisprudence; 1-4 February 21, 2001, reported favorably by the following vote: Yeas 1-5 7, Nays 0; February 21, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the performance of an autopsy on an individual injured 1-9 in one county and dying in another county. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Article 49.10, Code of Criminal Procedure, is 1-12 amended by adding Subsection (o) to read as follows: 1-13 (o) If a person is injured in one county and dies as a 1-14 result of those injuries, with the death occurring in another 1-15 county, the attorney representing the state in the prosecution of 1-16 felonies in the county in which the injury occurred may request a 1-17 justice of the peace in the county in which the death occurred to 1-18 order an autopsy be performed on the body of the deceased person. 1-19 If the justice of the peace orders that the autopsy be performed, 1-20 the county in which the injury occurred shall reimburse the county 1-21 in which the death occurred. 1-22 SECTION 2. This Act takes effect immediately if it receives 1-23 a vote of two-thirds of all the members elected to each house, as 1-24 provided by Section 39, Article III, Texas Constitution. If this 1-25 Act does not receive the vote necessary for immediate effect, this 1-26 Act takes effect September 1, 2001. 1-27 * * * * *
