                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to punishment for the sale of an alcoholic beverage to a
 1-3     minor.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 106.03, Alcoholic Beverage Code, is
 1-6     amended by amending Subsection (c) and adding Subsection (d) to
 1-7     read as follows:
 1-8           (c)  Except as provided by Subsection (d), an [An] offense
 1-9     under this section is a Class A misdemeanor.
1-10           (d)  If a person has been previously convicted of an offense
1-11     under this section or Section 101.63, an offense under this section
1-12     is a state jail felony.
1-13           SECTION 2.  (a)  This Act takes effect September 1, 2001.
1-14     The change in law made by this Act applies only to an offense
1-15     committed on or after the effective date of this Act.  For purposes
1-16     of this section, an offense is committed before the effective date
1-17     of this Act if any element of the offense occurs before that date. 
1-18           (b)  An offense committed before the effective date of this
1-19     Act is covered by the law in effect when the offense was committed,
1-20     and the former law is continued in effect for that purpose.
