A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the listing of state agency Internet addresses in
1-3 telephone directories.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 55.203, Utilities Code, is amended to
1-6 read as follows:
1-7 Sec. 55.203. DIRECTORY PUBLISHED BY PRIVATE PUBLISHER.
1-8 (a) In this section, "Internet" means the largest nonproprietary,
1-9 nonprofit cooperative public computer network, popularly known as
1-10 the Internet.
1-11 (b) A private for-profit publisher of a residential
1-12 telephone directory that is distributed to the public at minimal or
1-13 no cost shall include in the directory a listing of any:
1-14 (1) toll-free and local telephone numbers of:
1-15 (A) [(1)] state agencies;
1-16 (B) [(2)] state public services; and
1-17 (C) [(3)] each state elected official who
1-18 represents all or part of the geographical area for which the
1-19 directory contains listings; and
1-20 (2) Universal Resource Locator (URL) of an Internet
1-21 site maintained by a state agency.
1-22 (c) [(b)] The listing required by this section must be:
1-23 (1) clearly identified; and
1-24 (2) located or clearly referenced at the front of the
1-25 directory before the main listing of residential and business
2-1 telephone numbers.
2-2 (d) [(c)] The commission by rule may specify:
2-3 (1) the format of the listing; and
2-4 (2) criteria for inclusion of agencies, services, and
2-5 officials.
2-6 (e) [(d)] The commission's rules must require a publisher to
2-7 list:
2-8 (1) the telephone number for state government
2-9 information; and
2-10 (2) telephone numbers and Universal Resource Locators
2-11 (URLs) alphabetically by:
2-12 (A) the subject matter of agency programs; and
2-13 (B) agency name.
2-14 (f) [(e)] The commission, with the cooperation of other
2-15 state agencies, shall:
2-16 (1) compile relevant information to ensure accuracy of
2-17 information in the listing; and
2-18 (2) provide the information to a telecommunications
2-19 utility or telephone directory publisher within a reasonable time
2-20 after a request by the utility or publisher.
2-21 (g) [(f)] The General Services Commission shall cooperate
2-22 with the commission and with publishers to ensure that the subject
2-23 matter listing of programs, [and] telephone numbers, and Universal
2-24 Resource Locators (URLs) in the telephone directories are
2-25 consistent with the categorization developed by the Records
2-26 Management Interagency Coordinating Council under Section
3-1 441.203(j) [441.053], Government Code.
3-2 SECTION 2. Subsection (j), Section 441.203, Government Code,
3-3 is amended to read as follows:
3-4 (j) In this subsection, "Internet" means the largest
3-5 nonproprietary, nonprofit cooperative public computer network,
3-6 popularly known as the Internet. The council shall categorize
3-7 state agency programs, state agency [and] telephone numbers, and
3-8 Universal Resource Locators (URLs) of Internet sites maintained by
3-9 state agencies by subject matter as well as by agency. The council
3-10 shall cooperate with the Texas Information and Referral Network
3-11 under Section 531.0312 to ensure that the council and the network
3-12 use a single method of defining and organizing information about
3-13 health and human services. State agencies shall cooperate with the
3-14 council by providing the council with the information it needs to
3-15 perform this function.
3-16 SECTION 3. This Act takes effect September 1, 2001.
