                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to employment contract requirements for certain public
 1-3     school principals.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 21.102(a), Education Code, is amended to
 1-6     read as follows:
 1-7           (a)  Except as provided by Section 21.202(b), a [A] person
 1-8     who is employed as a teacher by a school district for the first
 1-9     time, or who has not been employed by the district for two
1-10     consecutive school years subsequent to August 28, 1967, shall be
1-11     employed under a probationary contract.
1-12           SECTION 2. Section 21.202, Education Code, is amended to read
1-13     as follows:
1-14           Sec. 21.202. PROBATIONARY CONTRACT REQUIRED. (a)  Except as
1-15     provided by Subsection (b), before [Before] a teacher may be
1-16     employed under a term contract, the teacher must be employed under
1-17     a probationary contract for the period provided by Subchapter C.
1-18           (b)  A school district may employ a person as a principal
1-19     under a term contract if the person has at least five years of
1-20     experience as a principal, regardless of whether the person is
1-21     being employed by the school district for the first time or whether
1-22     the person has been employed by the district for two consecutive
1-23     school years subsequent to August 28, 1967.
1-24           SECTION 3. This Act applies beginning with the 2001-2002
 2-1     school year.
 2-2           SECTION 4.  This Act takes effect immediately if it receives
 2-3     a vote of two-thirds of all the members elected to each house, as
 2-4     provided by Section 39, Article III, Texas Constitution.  If this
 2-5     Act does not receive the vote necessary for immediate effect, this
 2-6     Act takes effect September 1, 2001.
