1-1 AN ACT
1-2 relating to the election of directors of the Clearwater Underground
1-3 Water Conservation District.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 10, Chapter 524, Acts of the 71st
1-6 Legislature, Regular Session, 1989, is amended to read as follows:
1-7 Sec. 10. METHOD OF ELECTING [ELECTION OF] DIRECTORS.
1-8 (a) The directors of the district shall be elected according to
1-9 the commissioners precinct method as provided by this section.
1-10 (b) One director shall be elected by the electors of the
1-11 entire district and one director shall be elected from each county
1-12 commissioners precinct by the electors of that precinct.
1-13 (c) To be qualified to be a candidate for or to serve as
1-14 director at large, a person must be a registered voter in the
1-15 district. To be a candidate for or to serve as director from a
1-16 county commissioners precinct, a person must be a registered voter
1-17 of that precinct.
1-18 (d) A person shall indicate on the application for a place
1-19 on the ballot:
1-20 (1) the precinct that the person seeks to represent;
1-21 or
1-22 (2) that the person seeks to represent the district at
1-23 large.
1-24 (e) After the initial election of directors, all directors
1-25 shall be elected to serve four-year terms, except as provided by
2-1 Subsection (f). The terms of directors are staggered. On the
2-2 first Saturday in May of even-numbered years, the appropriate
2-3 number of directors shall be elected.
2-4 (f) At the first election after the county commissioners
2-5 precincts are redrawn under Section 18, Article V, Texas
2-6 Constitution, four new directors shall be elected to represent the
2-7 newly redrawn precincts. The directors from precincts one and
2-8 three shall be elected for two-year terms. The directors from
2-9 precincts two and four shall be elected for four-year terms. When
2-10 the directors elected from the new precincts take office, the terms
2-11 of the directors elected from the previous precincts expire. [On
2-12 the first Saturday in May of the second year after the year in
2-13 which the district is authorized to be created at a confirmation
2-14 election, an election shall be held in the district for the
2-15 election of two directors who shall each serve two-year terms and
2-16 three directors who shall each serve four-year terms. Thereafter,
2-17 on the same date in each subsequent second year, the appropriate
2-18 number of directors shall be elected to the board.]
2-19 SECTION 2. If this Act takes effect before May 5, 2001:
2-20 (1) the Clearwater Underground Water Conservation
2-21 District:
2-22 (A) by order of the board of directors of the
2-23 district shall cancel any scheduled election of directors; and
2-24 (B) may not hold an election of directors before
2-25 May, 2002;
2-26 (2) on the first Saturday in May, 2002, the Clearwater
3-1 Underground Water Conservation District shall hold an election of:
3-2 (A) one director from the district at large, to
3-3 serve a term of four years;
3-4 (B) one director from Bell County Commissioners
3-5 Court Precinct Number One, to serve a term of two years;
3-6 (C) one director from Bell County Commissioners
3-7 Court Precinct Number Two, to serve a term of four years;
3-8 (D) one director from Bell County Commissioners
3-9 Court Precinct Number Three, to serve a term of two years; and
3-10 (E) one director from Bell County Commissioners
3-11 Court Precinct Number Four, to serve a term of four years;
3-12 (3) directors of the Clearwater Underground Water
3-13 Conservation District serving on the effective date of this Act
3-14 shall continue to serve until their successors take office
3-15 following the election under this section; and
3-16 (4) the secretary of state shall assist and advise the
3-17 appropriate election authorities regarding the cancellation of the
3-18 scheduled election.
3-19 SECTION 3. Notwithstanding Subsection (f), Section 10,
3-20 Chapter 524, Acts of the 71st Legislature, Regular Session, 1989,
3-21 as amended by this Act, if this Act takes effect on or after May 5,
3-22 2001:
3-23 (1) on the first Saturday in May, 2002, the Clearwater
3-24 Underground Water Conservation District shall hold an election of:
3-25 (A) one director from Bell County Commissioners
3-26 Court Precinct Number One, to serve a term of four years; and
4-1 (B) one director from Bell County Commissioners
4-2 Court Precinct Number Three, to serve a term of four years; and
4-3 (2) on the first Saturday in May, 2004, the Clearwater
4-4 Underground Water Conservation District shall hold an election of:
4-5 (A) one director from the district at large, to
4-6 serve a term of four years;
4-7 (B) one director from Bell County Commissioners
4-8 Court Precinct Number Two, to serve a term of four years; and
4-9 (C) one director from Bell County Commissioners
4-10 Court Precinct Number Four, to serve a term of four years.
4-11 SECTION 4. This Act takes effect immediately if it receives
4-12 a vote of two-thirds of all the members elected to each house, as
4-13 provided by Section 39, Article III, Texas Constitution. If this
4-14 Act does not receive the vote necessary for immediate effect, this
4-15 Act takes effect September 1, 2001.
