1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the election of directors of the Clearwater Underground
1-9 Water Conservation District.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 10, Chapter 524, Acts of the 71st
1-12 Legislature, Regular Session, 1989, is amended to read as follows:
1-13 Sec. 10. METHOD OF ELECTING [ELECTION OF] DIRECTORS.
1-14 (a) The directors of the district shall be elected according to
1-15 the commissioners precinct method as provided by this section.
1-16 (b) One director shall be elected by the electors of the
1-17 entire district and one director shall be elected from each county
1-18 commissioners precinct by the electors of that precinct.
1-19 (c) To be qualified to be a candidate for or to serve as
1-20 director at large, a person must be a registered voter in the
1-21 district. To be a candidate for or to serve as director from a
1-22 county commissioners precinct, a person must be a registered voter
1-23 of that precinct.
1-24 (d) A person shall indicate on the application for a place
1-25 on the ballot:
1-26 (1) the precinct that the person seeks to represent;
1-27 or
1-28 (2) that the person seeks to represent the district at
1-29 large.
1-30 (e) After the initial election of directors, all directors
1-31 shall be elected to serve four-year terms, except as provided by
1-32 Subsection (f). The terms of directors are staggered. On the
1-33 first Saturday in May of even-numbered years, the appropriate
1-34 number of directors shall be elected.
1-35 (f) At the first election after the county commissioners
1-36 precincts are redrawn under Section 18, Article V, Texas
1-37 Constitution, four new directors shall be elected to represent the
1-38 newly redrawn precincts. The directors from precincts one and
1-39 three shall be elected for two-year terms. The directors from
1-40 precincts two and four shall be elected for four-year terms. When
1-41 the directors elected from the new precincts take office, the terms
1-42 of the directors elected from the previous precincts expire. [On
1-43 the first Saturday in May of the second year after the year in
1-44 which the district is authorized to be created at a confirmation
1-45 election, an election shall be held in the district for the
1-46 election of two directors who shall each serve two-year terms and
1-47 three directors who shall each serve four-year terms. Thereafter,
1-48 on the same date in each subsequent second year, the appropriate
1-49 number of directors shall be elected to the board.]
1-50 SECTION 2. If this Act takes effect before March 21, 2001:
1-51 (1) the Clearwater Underground Water Conservation
1-52 District may not hold an election of directors before May, 2002;
1-53 (2) on the first Saturday in May, 2002, the Clearwater
1-54 Underground Water Conservation District shall hold an election of:
1-55 (A) one director from the district at large, to
1-56 serve a term of four years;
1-57 (B) one director from Bell County Commissioners
1-58 Court Precinct Number One, to serve a term of two years;
1-59 (C) one director from Bell County Commissioners
1-60 Court Precinct Number Two, to serve a term of four years;
1-61 (D) one director from Bell County Commissioners
1-62 Court Precinct Number Three, to serve a term of two years; and
1-63 (E) one director from Bell County Commissioners
1-64 Court Precinct Number Four, to serve a term of four years; and
2-1 (3) directors of the Clearwater Underground Water
2-2 Conservation District serving on the effective date of this Act
2-3 shall continue to serve until their successors take office
2-4 following the election under this section.
2-5 SECTION 3. Notwithstanding Subsection (f), Section 10,
2-6 Chapter 524, Acts of the 71st Legislature, Regular Session, 1989,
2-7 as amended by this Act, if this Act takes effect on or after March
2-8 21, 2001:
2-9 (1) on the first Saturday in May, 2002, the Clearwater
2-10 Underground Water Conservation District shall hold an election of:
2-11 (A) one director from Bell County Commissioners
2-12 Court Precinct Number One, to serve a term of four years; and
2-13 (B) one director from Bell County Commissioners
2-14 Court Precinct Number Three, to serve a term of four years; and
2-15 (2) on the first Saturday in May, 2004, the Clearwater
2-16 Underground Water Conservation District shall hold an election of:
2-17 (A) one director from the district at large, to
2-18 serve a term of four years;
2-19 (B) one director from Bell County Commissioners
2-20 Court Precinct Number Two, to serve a term of four years; and
2-21 (C) one director from Bell County Commissioners
2-22 Court Precinct Number Four, to serve a term of four years.
2-23 SECTION 4. This Act takes effect immediately if it receives
2-24 a vote of two-thirds of all the members elected to each house, as
2-25 provided by Section 39, Article III, Texas Constitution. If this
2-26 Act does not receive the vote necessary for immediate effect, this
2-27 Act takes effect September 1, 2001.
