                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to state agency information resources management.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 2054.051, Government Code, is amended by
 1-5     adding Subsection (f) to read as follows:
 1-6           (f)  The department shall identify opportunities for state
 1-7     agencies to coordinate with each other in the adoption and
 1-8     implementation of information resources technology projects.
 1-9           SECTION 2.  Subchapter C, Chapter 2054, Government Code, is
1-10     amended by adding Section 2054.0535 to read as follows:
1-11           Sec. 2054.0535.  NONCOMPLIANCE WITH CHAPTER.  (a)  On
1-12     determining that a state agency is not in compliance with a
1-13     requirement of this chapter, the director of the Legislative Budget
1-14     Board, in cooperation with the department and as soon as is
1-15     practicable, shall deliver written notice of the noncompliance to
1-16     the agency's executive director or other chief administrative
1-17     officer, the members of the agency's governing board, the
1-18     comptroller, the governor, the lieutenant governor, the speaker of
1-19     the house of representatives, and the members of the Legislative
1-20     Budget Board.
1-21           (b)  The director of the Legislative Budget Board, in
1-22     cooperation with the department, may issue a certificate of
1-23     noncompliance to a state agency if, after receipt of notice under
1-24     Subsection (a), the agency fails to comply with a requirement of
1-25     this chapter within the period determined by the director.
 2-1           (c)  On request of the director of the Legislative Budget
 2-2     Board following issuance of a certificate of noncompliance to a
 2-3     state agency, the comptroller shall allow the agency to access the
 2-4     agency's appropriations that relate to information resources,
 2-5     including information resources technologies and projects, only
 2-6     with prior approval of the Legislative Budget Board.
 2-7           SECTION 3.  Subsection (a), Section 2054.096, Government
 2-8     Code, is amended to read as follows:
 2-9           (a)  Each agency strategic plan must be consistent with the
2-10     state strategic plan and include:
2-11                 (1)  a statement of the state agency's goals,
2-12     objectives, and programs as found in the agency's legislative
2-13     appropriations request;
2-14                 (2)  a description of the agency's major data bases and
2-15     their applications;
2-16                 (3)  a description of the agency's information
2-17     resources management organizations, policies, and practices;
2-18                 (4)  a description of interagency computer networks in
2-19     which the agency participates;
2-20                 (5)  a statement of the strategic objectives of the
2-21     agency relating to information resources management for the next
2-22     five fiscal years, beginning with the fiscal year during which the
2-23     plan is submitted, with a description of how those objectives help
2-24     achieve the agency's programs and goals, and a description of how
2-25     those objectives support and promote the goals and policies of the
2-26     state strategic plan;
 3-1                 (6)  a description of any information resources
 3-2     technology projects proposed by the agency, including:
 3-3                       (A)  a statement of how the projects relate to
 3-4     similar projects implemented or proposed by other agencies, as
 3-5     identified by the department or the agency; and
 3-6                       (B)  a description of any proposed plans for
 3-7     coordinating the projects with other agencies;  and
 3-8                 (7) [(6)]  other planning components that the
 3-9     department may prescribe.
3-10           SECTION 4.  This Act takes effect September 1, 2001.
