                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the disposition of certain fees and penalties collected
 1-3     by the Department of Public Safety.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Sections 521.055(d), (e), and (f), Transportation
 1-6     Code, are amended to read as follows:
 1-7           (d)  [Fifty cents of each fee collected under Subsection (c)
 1-8     shall be deposited in a special account in the general revenue fund
 1-9     that may be appropriated only to the department for administration
1-10     of this chapter.]
1-11           [(e)]  The department may contract with private vendors as
1-12     necessary to implement this section.
1-13           (e) [(f)]  The department may adopt rules as necessary to
1-14     administer this section.
1-15           SECTION 2. Subchapter C, Chapter 521, Transportation Code, is
1-16     amended by adding Section 521.058 to read as follows:
1-17           Sec. 521.058.  DISPOSITION OF FEES. Each fee collected under
1-18     this subchapter shall be deposited to the credit of the state
1-19     highway fund.
1-20           SECTION 3. Section 521.313, Transportation Code, is amended
1-21     by adding Subsection (c) to read as follows:
1-22           (c)  Each fee collected under this section shall be deposited
1-23     to the credit of the state highway fund.
1-24           SECTION 4. Section 521.3466, Transportation Code, is amended
 2-1     by adding Subsection (e) to read as follows:
 2-2           (e)  Each fee collected under this section shall be deposited
 2-3     to the credit of the state highway fund.
 2-4           SECTION 5. Subchapter R, Chapter 521, Transportation Code, is
 2-5     amended by adding Section 521.428 to read as follows:
 2-6           Sec. 521.428.  DISPOSITION OF FEES. (a)  Except as provided
 2-7     by Subsection (b), each fee collected under this subchapter shall
 2-8     be deposited to the credit of the state highway fund.
 2-9           (b)  Subsection (a)  does not apply to a fee collected under:
2-10                 (1)  Section 521.421(f), as added by Chapter 510, Acts
2-11     of the 75th Legislature, Regular Session, 1997;
2-12                 (2)  Section 521.421(g); or
2-13                 (3)  Section 521.422(b) or (c).
2-14           SECTION 6. Section 522.029, Transportation Code, is amended
2-15     by adding Subsection (h) to read as follows:
2-16           (h)  Each fee collected under this section shall be deposited
2-17     to the credit of the state highway fund.
2-18           SECTION 7. Section 524.051, Transportation Code, is amended
2-19     by adding Subsection (c) to read as follows:
2-20           (c)  Each fee collected under this section shall be deposited
2-21     to the credit of the state highway fund.
2-22           SECTION 8. Subchapter H, Chapter 548, Transportation Code, is
2-23     amended by adding Section 548.508 to read as follows:
2-24           Sec. 548.508.  DISPOSITION OF FEES. Except as provided by
2-25     Section 382.0622, Health and Safety Code, each fee collected by the
2-26     department under this subchapter shall be deposited to the credit
2-27     of the state highway fund.
 3-1           SECTION 9. Section 661.003, Transportation Code, is amended
 3-2     by adding Subsection (j) to read as follows:
 3-3           (j)  Each fee collected under Subsection (d) shall be
 3-4     deposited to the credit of the state highway fund.
 3-5           SECTION 10. Section 644.153, Transportation Code, is amended
 3-6     by adding Subsection (i) to read as follows:
 3-7           (i)  Each penalty collected under this section shall be
 3-8     deposited to the credit of the state highway fund.
 3-9           SECTION 11. Section 724.046, Transportation Code, is amended
3-10     by adding Subsection (c) to read as follows:
3-11           (c)  Each fee collected under this section shall be deposited
3-12     to the credit of the state highway fund.
3-13           SECTION 12. Section 662.011, Transportation Code, is
3-14     repealed.
3-15           SECTION 13. This Act takes effect September 1, 2001, and
3-16     applies only to a fee or penalty collected by the Department of
3-17     Public Safety  on or after that date.
