A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to student intercollegiate athletic fees at The University
1-3 of Texas of the Permian Basin.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter E, Chapter 54, Education Code, is
1-6 amended by adding Section 54.5331 to read as follows:
1-7 Sec. 54.5331. INTERCOLLEGIATE ATHLETIC FEE; THE UNIVERSITY
1-8 OF TEXAS OF THE PERMIAN BASIN. (a) The board of regents of The
1-9 University of Texas System may impose a mandatory intercollegiate
1-10 athletics fee at The University of Texas of the Permian Basin if
1-11 the fee is approved by a majority vote of the students
1-12 participating in a general student election held for that purpose.
1-13 The amount of the fee may not exceed $5 per semester credit hour
1-14 for each regular semester in the first academic year in which the
1-15 fee is imposed.
1-16 (b) The amount of the fee per semester credit hour may be
1-17 increased from one academic year to the next only if the increase
1-18 is approved by a majority vote of the students of the university
1-19 participating in a general student election held for that purpose.
1-20 (c) The board of regents may prorate the amount of the fee
1-21 for a summer session.
1-22 (d) The fee imposed under this section is in addition to any
1-23 other fee authorized by law and may not be considered in
1-24 determining the maximum student services fees that may be imposed
2-1 under Section 54.503.
2-2 (e) If a mandatory intercollegiate athletics fee in an
2-3 amount within the limit provided by Subsection (a) was approved by
2-4 a majority vote of the students of the university participating in
2-5 a general student election held on or after January 1, 2000, the
2-6 board of regents may impose the fee without calling an additional
2-7 election under Subsection (a). This subsection expires January 1,
2-8 2003.
2-9 SECTION 2. This Act takes effect immediately if it receives
2-10 a vote of two-thirds of all the members elected to each house, as
2-11 provided by Section 39, Article III, Texas Constitution. If this
2-12 Act does not receive the vote necessary for immediate effect, this
2-13 Act takes effect on the 91st day after the last day of the
2-14 legislative session. This Act applies beginning with the 2001 fall
2-15 semester.
