                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to requirements applicable to renovation of public school
 1-3     facilities financed with state assistance.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter A, Chapter 46, Education Code, is
 1-6     amended by adding Section 46.0081 to read as follows:
 1-7           Sec. 46.0081.  SURVEY REQUIREMENT FOR RENOVATION PROJECTS.
 1-8     (a)  A school district may not use state funds received under this
 1-9     subchapter to pay the costs of renovating an instructional facility
1-10     unless the district obtains a copy of a survey that analyzes the
1-11     facility's overall indoor environmental quality.
1-12           (b)  The survey required by this section must be conducted by
1-13     an independent professional not regularly employed by the school
1-14     district.
1-15           SECTION 2.  Section 46.0081, Education Code, as added by this
1-16     Act, does not apply to a renovation project for which working
1-17     drawings were completed before the effective date of this Act.  A
1-18     renovation project for which working drawings were completed before
1-19     the effective date of this Act is governed by the law in effect at
1-20     the time the drawings were completed, and that law is continued in
1-21     effect for that purpose.
1-22           SECTION 3.  This Act takes effect September 1, 2001.
