1-7 AN ACT
1-8 relating to information a state agency may post on the Internet.
1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10 SECTION 1. Section 2054.121, Government Code, as added by
1-11 Chapter 1573, Acts of the 76th Legislature, Regular Session, 1999,
1-12 is amended to read as follows:
1-13 Sec. 2054.121. [REQUIRED] POSTING OF INFORMATION ON
1-14 INTERNET. (a) Each state agency, other than an institution of
1-15 higher education, that receives an aggregate amount of
1-16 appropriations in the General Appropriations Act for a state fiscal
1-17 biennium that exceeds $175 million shall post the following
1-18 information during the biennium on a generally accessible Internet
1-19 site maintained by or for the agency:
1-20 (1) an analysis of all agency expenditures during the
1-21 two preceding state fiscal years that lists each county in the
1-22 state and states for each county the amount of agency expenditures
1-23 made in or for the benefit of the county;
1-24 (2) if the information required to substantially
1-25 comply with Subdivision (1) is not available, an analysis that
1-26 approximates compliance with Subdivision (1) to the greatest
1-27 possible extent by listing agency expenditures according to
1-28 geographic regions of the state, to the extent possible, and by
1-29 each field office of the agency;
1-30 (3) a profile of the governing officer or of each
1-31 member of the governing body of the agency that includes, among
1-32 other information, the office address of the officer or member;
1-33 (4) a listing and description of all contracts with
1-34 vendors that have a value exceeding $100,000 that the agency has
1-35 entered into and that are currently being performed or for which
1-36 performance has not yet begun;
1-37 (5) a brief description of the agency's duties; and
1-38 (6) an electronic link to the agency's rules as
1-39 published in the electronic version of the Texas Administrative
1-40 Code and an electronic link to any written procedure of the agency
1-41 relating to agency hearings that is not contained in the electronic
1-42 version of the Texas Administrative Code.
1-43 (b) Each state agency that maintains a generally accessible
1-44 Internet site or for which a generally accessible Internet site is
1-45 maintained may post on the site any nonconfidential information
1-46 related to the agency's programs, activities, or functions.
1-47 SECTION 2. This Act takes effect September 1, 2001.
