No. 557 By: Cain 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to overtime compensation for certain municipal police 1-11 department officers and civilian employees. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Chapter 142, Local Government Code, is amended by 1-14 adding Section 142.012 to read as follows: 1-15 Sec. 142.012. OVERTIME COMPENSATION FOR CERTAIN POLICE 1-16 DEPARTMENT OFFICERS AND CIVILIAN EMPLOYEES. (a) This section 1-17 applies only to a municipality with a population of one million or 1-18 more that has not adopted Chapter 143. 1-19 (b) Subject to the federal Fair Labor Standards Act of 1938 1-20 (29 U.S.C. Section 201 et seq.), a municipality may but is not 1-21 required to establish a system under which compensation is paid or 1-22 compensatory time off is allowed for overtime worked by the 1-23 following officers and employees of the municipality's police 1-24 department: 1-25 (1) a police officer who has a rank above the rank of 1-26 captain and whose appointment to the officer's current rank was not 1-27 based at least in part on the officer's performance on a 1-28 competitive examination; or 1-29 (2) a civilian who receives a salary greater than the 1-30 lowest base salary that the municipality pays a captain and whose 1-31 appointment to the civilian's current position was not based at 1-32 least in part on the civilian's performance on a competitive 1-33 examination. 1-34 SECTION 2. This Act takes effect September 1, 2001. The 1-35 change in law made by this Act applies beginning with the first 1-36 full pay period that begins on or after that date. 1-37 * * * * *
