No. 558 By: Moncrief 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to an advisory committee on reducing drug demand. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Chapter 461, Health and Safety Code, is amended 1-13 by adding Section 461.017 to read as follows: 1-14 Sec. 461.017. ADVISORY COMMITTEE ON REDUCING DRUG DEMAND. 1-15 (a) The Drug Demand Reduction Advisory Committee is composed of 1-16 the following 19 members: 1-17 (1) five representatives of the public from different 1-18 geographic regions of the state who have knowledge and expertise in 1-19 issues relating to reducing drug demand and who are appointed by 1-20 the executive director of the Texas Commission on Alcohol and Drug 1-21 Abuse; and 1-22 (2) one representative of each of the following 1-23 agencies or offices who is appointed by the executive director or 1-24 commissioner of the agency or office and who is directly involved 1-25 in the agency's or office's policies, programs, or funding 1-26 activities relating to reducing drug demand: 1-27 (A) the criminal justice division of the 1-28 governor's office; 1-29 (B) the Criminal Justice Policy Council; 1-30 (C) the Department of Protective and Regulatory 1-31 Services; 1-32 (D) the Department of Public Safety of the State 1-33 of Texas; 1-34 (E) the Health and Human Services Commission; 1-35 (F) the Texas Alcoholic Beverage Commission; 1-36 (G) the Texas Commission on Alcohol and Drug 1-37 Abuse; 1-38 (H) the Texas Department of Criminal Justice; 1-39 (I) the Texas Department of Health; 1-40 (J) the Texas Department of Human Services; 1-41 (K) the Texas Department of Mental Health and 1-42 Mental Retardation; 1-43 (L) the Texas Education Agency; 1-44 (M) the Texas Juvenile Probation Commission; and 1-45 (N) the Texas Youth Commission. 1-46 (b) The representative of the Texas Commission on Alcohol 1-47 and Drug Abuse shall serve as the presiding officer of the Drug 1-48 Demand Reduction Advisory Committee. The commission may provide 1-49 administrative support to the committee. 1-50 (c) The Drug Demand Reduction Advisory Committee shall meet 1-51 at least once in each quarter of each calendar year on dates 1-52 determined by the committee. 1-53 (d) The Drug Demand Reduction Advisory Committee shall serve 1-54 as a single source of information for the governor, the 1-55 legislature, and the public about issues relating to reducing drug 1-56 demand, including available prevention programs and services. 1-57 (e) The Drug Demand Reduction Advisory Committee shall 1-58 develop a statewide strategy to reduce drug demand. The strategy 1-59 must: 1-60 (1) incorporate multidisciplinary approaches using 1-61 current empirical research; 1-62 (2) include performance-based measurement and 1-63 accountability standards, short-term objectives, and ten-year 1-64 targets for reducing drug demand; 2-1 (3) coordinate, to the extent possible, the efforts of 2-2 private sector entities and local, state, and federal agencies, 2-3 including the Office of National Drug Control Policy, to reduce 2-4 drug demand; and 2-5 (4) provide opportunities for representatives from the 2-6 public and private sectors to comment on the committee's activities 2-7 and make recommendations related to the strategy. 2-8 (f) The Drug Demand Reduction Advisory Committee shall 2-9 identify lead or contributing agencies or offices that shall 2-10 implement the strategy described in Subsection (e). The committee 2-11 shall coordinate the implementation of the strategy by those 2-12 agencies or offices. 2-13 (g) The Drug Demand Reduction Advisory Committee may 2-14 establish additional advisory committees composed of 2-15 representatives from governmental entities and the private sector 2-16 to assist the committee in carrying out its duties. 2-17 (h) Not later than January 15 of each odd-numbered year, the 2-18 Drug Demand Reduction Advisory Committee shall present to the 2-19 governor, the lieutenant governor, and the speaker of the house of 2-20 representatives a report that states: 2-21 (1) the committee's progress in developing and 2-22 coordinating the strategy described in Subsection (e); 2-23 (2) the status and funding of state programs relating 2-24 to reducing drug demand; and 2-25 (3) recommendations for legislation to address issues 2-26 involved in reducing drug demand. 2-27 SECTION 2. This Act takes effect immediately if it receives 2-28 a vote of two-thirds of all the members elected to each house, as 2-29 provided by Section 39, Article III, Texas Constitution. If this 2-30 Act does not receive the vote necessary for immediate effect, this 2-31 Act takes effect September 1, 2001. 2-32 * * * * *
