1-1 AN ACT
1-2 relating to the frequency with which a person may take an
1-3 examination administered by the Texas Board of Professional Land
1-4 Surveying.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Subsection (e), Section 16, Professional Land
1-7 Surveying Practices Act (Article 5282c, Vernon's Texas Civil
1-8 Statutes), is amended to read as follows:
1-9 (e) An applicant who fails an examination may apply to take
1-10 a subsequent examination [not earlier than six months from the date
1-11 of the failed examination] by filing an updated application and
1-12 paying an additional examination fee not to exceed $100.
1-13 SECTION 2. The change in law made by this Act to Subsection
1-14 (e), Section 16, Professional Land Surveying Practices Act (Article
1-15 5282c, Vernon's Texas Civil Statutes), applies to a person who
1-16 fails an examination before, on, or after the effective date of
1-17 this Act.
1-18 SECTION 3. This Act takes effect immediately if it receives
1-19 a vote of two-thirds of all the members elected to each house, as
1-20 provided by Section 39, Article III, Texas Constitution. If this
1-21 Act does not receive the vote necessary for immediate effect, this
1-22 Act takes effect September 1, 2001.
