 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the analysis of, and certain measures that address, the
1-11     staffing needs of state agencies.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Subsection (b), Section 812.202, Government Code,
1-14     is amended to read as follows:
1-15           (b)  The payment of benefits to a retiree for service
1-16     credited in the employee class of membership is not affected by the
1-17     retiree's taking[, for nine months or less within any fiscal year,]
1-18     a position included in the employee class.
1-19           SECTION 2.  Chapter 2056, Government Code, is amended by
1-20     adding Section 2056.0021 to read as follows:
1-21           Sec. 2056.0021.  WORKFORCE PLANNING.  As part of the
1-22     strategic plan required under Section 2056.002, a state agency
1-23     shall conduct a strategic staffing analysis and develop a workforce
1-24     plan, according to guidelines developed by the state auditor, to
1-25     address critical staffing and training needs of the agency,
1-26     including the need for experienced employees to impart knowledge to
1-27     their potential successors.
1-28           SECTION 3.  The following laws are repealed:
1-29                 (1)  Section 659.0115, Government Code;
1-30                 (2)  Subsections (a) and (b), Section 812.203,
1-31     Government Code; and
1-32                 (3)  Subsections (b) and (c), Section 2252.901,
1-33     Government Code.
1-34           SECTION 4.  This Act takes effect September 1, 2001.
