A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to compensation for services rendered at a polling place
1-3 by election officers.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 32.091, Election Code, is amended by
1-6 amending Subsection (a) and adding Subsection (c) to read as
1-7 follows:
1-8 (a) An election judge or clerk is entitled to compensation
1-9 for services rendered at a precinct polling place at an hourly rate
1-10 not to exceed $7.50 [$6]. A judge or clerk may be compensated at
1-11 that rate for services rendered under Section 62.014(c).
1-12 (c) The compensation fixed for judges and clerks for an
1-13 election ordered by an authority of a political subdivision other
1-14 than a county may not exceed the compensation fixed for an election
1-15 ordered by the governor or a county authority in the county in
1-16 which the political subdivision is primarily situated.
1-17 SECTION 2. Section 173.008, Election Code, is amended by
1-18 adding Subsection (e) to read as follows:
1-19 (e) The compensation payable to election judges and clerks
1-20 for a primary election that is conducted by the county election
1-21 officer under an election services contract must be at least equal
1-22 to the compensation payable to judges and clerks for an election
1-23 ordered by the governor or a county authority in that county.
1-24 SECTION 3. This Act takes effect September 1, 2001.
